End user license Agreement Version 1.2 - March 2016
Welcome to UX Map (the Product), a toolkit for user interface design documentation created by Luca Benazzi.
Your use of UX Map is subject to this license agreement. By using UX Map, you accept the terms and conditions of this license agreement including without limitation all prices and payment terms, as well as the privacy policy.
Please read the terms and conditions carefully before you purchase a license to use UX Map. Use of UX Map implies that anyone (individual or entity, inclusive of affiliates and subsidiaries) who is assigned a license under the terms and conditions of this Agreement (each an "Authorized User") accepts and agrees to be bound to these Terms.
UX Map is a package containing resources that can be used to enhance the design deliverables that you create with prototyping software Axure RP, and is delivered to you in the form of downloadable files. Specifically, these consist of widget libraries and template files. Make sure you have a valid license of the software required to use this material (Axure RP version 7.0 or higher). As a collection of icons from the Font Awesome collection was used, it is recommended that you also download and install the font at http://fontawesome.io, if it is not already installed on your machine.
This Agreement only confers upon you a license of use to UX Map ("License"). This license does not convey to you any rights of ownership in or to UX Map. When purchasing a license of use you acknowledge that the ownership of UX Map remains with Luca Benazzi. This includes the site www.ux-map.com and its original content, features and functionality, and the packages that can be downloaded by purchasing a License.
Technical measures have been also implemented to prevent illegal copying or distribution of the Product. UX Map is protected by international copyright and trademark law.
Luca Benazzi grants you a perpetual, non-exclusive, non-transferable, License to use UX Map for your purposes, in accordance with this Agreement.
Each License is uniquely associated with one user. Companies or organisations willing to have a larger number of authorized users have to purchase a multiple license. Multiple users using a single License will be flagged and their License may be subject to termination.
To the extent a company or organisation have acquired multiple Licenses, they are allowed to distribute the UX Map to the agreed number of Authorized Users (employee, contractor or consultant) within the same company or organisation.
A Company or organization can reassign their license within their employees, contractors or consultants for use solely on behalf of the same company or organisation, in the event that (a) the prior named user is no longer working for the above mentioned company or organisation, or (b) the prior named user has changed roles and has no intent to use the UX Map in the new role.
You can acquire a License of use against a one-time fee paid to Luca Benazzi as stated on the website at the time of purchase.
You may modify the resources according to your requirements. For example, you may include UX Map resources in a prototype you will be designing for yourself or for your clients. You are not required to attribute the authorship or link to Luca Benazzi in a project. Luca Benazzi will not be responsible for any outcome that may occur due to usage of UX Map.
You must at all times: (a) ensure that only an Authorized User may use the Product and only in accordance with the terms and conditions of this Agreement; (b) promptly advise Luca Benazzi, including in writing, if you become aware of any unauthorized use or distribution of the Product by any person.
Upon receipt of the one-time license fee, you are granted a licence of use and become an authorized user of the UX Map. Under this license, Luca Benazzi will (a) supply you with the Product via electronic download; and (b) provide software maintenance in the form of updates and/or enhancements.
Updates and enhancement will be made generally available to customers from time to time. Nevertheless, by purchasing a license of use you acknowledge that Luca Benazzi has no obligation to provide updates on any regular schedule and will issue them in his sole and absolute discretion. Luca Benazzi may also cease offering and providing maintenance in his sole and absolute discretion.
Luca Benazzi does not claim ownership of your Content.
You may not, without the prior written consent of Luca Benazzi, perform any of the following, whether through deliberate or negligent act or act of omission:
a) redistribute, lease, sell, resell, license, sub-license, reproduce, translate or reduce to or from any electronic medium or machine readable form the Product or any data/information provided, or cause the distribution of the Product (or part of it) to any third party. This will be considered as a redistribution of UX Map resources, and is not allowed by the Terms of this License;
b) decompile, reverse engineer, disassemble, modify, adapt, convert, create derivative works from, or otherwise attempt to derive the Product;
c) publish, promote, broadcast, circulate or refer publicly to the Product name, trade name, trademark, service mark or logo;
d) commit any act or omission the likely result of which is that Luca Benazzi's reputation will be brought into disrepute or which act or omission could reasonably be expected to have or does have a material and adverse effect on Luca Benazzi's interests.
If Luca Benazzi reasonably suspects that the Product has been distributed to or obtained by any person or party without Luca Benazzi's prior written consent, Luca Benazzi has the right to reasonably request from the Authorized User an unqualified certificate executed by the Authorized User's auditor at the Authorized User's cost for the purpose of verifying compliance with authorized use of the Product.
In no event shall Luca Benazzi, nor any of his partners, suppliers, or affiliates, be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use the Product, even if Luca Benazzi or an authorised representative has been advised of the possibility of such damages. You agree to defend, indemnify and hold Luca Benazzi harmless from any claims, losses, liability costs and expenses, including but not limited to attorney’s fees, arising from your violation of any third-party’s rights.
Your use of the Product is at your sole risk. The Product is provided on an “as is” and “as available” basis. The Product is licensed without warranties of any kind, whether express or implied, of any kind or nature, including, but not limited to, any warranties of performance or merchantability or fitness for a particular purpose, non-infringement or course of performance.
Luca Benazzi, his partners, suppliers or affiliates, do not warrant that a) the Product will be error-free, complete, or correct b) the Product will function uninterrupted, secure or available at any particular time or location; c) any errors or defects will be corrected; d) the Product is free of viruses or other harmful components; or e) the results of using the Product will meet your requirements.
Luca Benazzi respects each individual’s right to personal privacy. Your personal information (such as name or e-mail) is only going to be used to track sales, visits to the website or send periodic e-mails with important updates. Your personal information will not be transferred to any other company. For more details please refer to the Privacy Policy documentation on the site, which is part of these Terms.
Apple, Android Windows, LinkedIn, Twitter, Facebook, Google, YouTube and all other logos and symbols that have been linked are registered trademarks.

The Product may contain links to third-party sites that are not owned or controlled by Luca Benazzi. Luca Benazzi has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services.
Luca Benazzi reserves the right, at his sole discretion, to modify or replace these Terms by posting the updated terms and conditions on the Product site. Your continued use of the Product for a period of two weeks after any such changes constitutes your acceptance of the new terms.
Please review this Agreement periodically for changes. If you do not agree to any changes to these Terms, do not use, access or continue to access the Product or discontinue any use of the Product immediately.
You may not amend this Agreement without prior written consent of Luca Benazzi. You may assign this Agreement to succeeding parties in the case of a merger, acquisition or change of control so long as in doing so, Luca Benazzi is notified in writing within ninety (90) days of the closure of such transaction. If you merge into or with a direct competitor of Luca Benazzi, as determined in Luca Benazzi's sole discretion, then this Agreement will automatically terminate as of the effective date of such merger. Luca Benazzi may assign its rights and obligation under this Agreement without your consent.
Once you make a payment, you have the right to withdraw from this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform Luca Benazzi of your decision to withdraw from this contract by an unequivocal statement (a letter sent via e-mail). You may use the following form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, Luca Benazzi will reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which you informed about your decision to withdraw from this contract. In any event, you will not incur any fees as a result of such re-imbursement.
By acknowledging the information provided on the right of withdrawal, the consumer expressly agrees to the execution of the contract by the company before the expiration of the withdrawal period and the consumer confirms their knowledge that they will lose their right to withdrawal with the beginning of the execution of the contract.
Either party hereto may terminate this Agreement if the other party commits a material breach and such party does not cure such material breach within fifteen (15) days of written notice of such breach. You agree upon termination of this Agreement to destroy all copies of the Product in your possession.
Payments you made under this Agreement exclude any taxes or duties payable in respect of the goods or services supplied in the jurisdiction where the payment is made or received. To the extent that any such taxes or duties are payable by Luca Benazzi, the Licensee must pay to Luca Benazzi the amount of such taxes or duties in addition to the license fee under this Agreement, unless you are exempt from paying such taxes or duties at the time such taxes or duties are levied or assessed. Luca Benazzi will provide you with documents requested to enable you to obtain a tax or duty refund or credit.
The consumer resident in Europe must be aware
that the European Commission has established an online platform for alternative
dispute resolutions that provides an out-of-court method to solve any dispute
related to and stemming from online sale and service contracts. As a
consequence, if you are a European consumer, you can use such platform for
resolving any dispute stemming from the online contract entered into with Luca
Benazzi. The platform is available at the following link:
http://ec.europa.eu/consumers/odr/.

This Agreement (and any further rules, policies, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Germany, without giving effect to any principles of conflicts of law.
